As business between China and the United States has grown, the amount of litigation in Chinese and U.S. courts has also grown. The American Law Institute has just completed a five-year project of restating many of the doctrines that apply to international litigation involving Chinese parties in U.S. courts. These doctrines include the extraterritorial application of law, the doctrine of foreign state compulsion, the doctrine of foreign sovereign immunity, and the enforcement of foreign judgments. Professor Dodge served as a reporter for the new Restatement of Foreign Relations Law. In this talk, he will provide an overview of the most important doctrines that arise in litigation between Chinese and U.S. parties. push.docx |
