Andre Seeck

After studying mechanical engineering, specializing in automotive engineering, at the Technical University of Braunschweig, Andre Seeck started his career 1993 as a researcher in the Federal Highway Research Institute (BASt) in section "Passive Vehicle Safety, Biomechanics". There, he led various research projects in preparation for the European Safety Regulations for motor vehicles. From 2001, he took over the leadership of the newly formed section "Vehicle-safety Assessment, Driver Assistance Systems," and since 2008 he is the head of the division "Automotive Engineering" in the Federal Highway Research Institute (BASt). Since 2022 he is the Vice-president of BASt.

In this position he is responsible for the preparation of European Safety Regulations. He is also head of the Euro NCAP strategy group on automated driving and on rating system. Furthermore, he represents the German Federal Ministry for Digital and Transport in the Board of Directors of Euro NCAP. From 2010 to 2014, Andre Seeck was the President of Euro NCAP.

In 2017 NHTSA awarded him the U. S. Government Special Award of Appreciation.

Legal Requirements for Automated and Autonomous Driving

On the basis of the international SAE-J3016-classification the presentation gives insight into the complete legal framework for automated and autonomous driving (Level 3 and Level 4) from a German perspective and includes European regulations taking effect for Germany. All legal regulations have been enacted on the basis of an experimentation clauses and require evaluation. However, they already allow the full regular (economic) use today and are not limited to testing only.

For Level 3-automation the general legal framework allows drivers to engage in non-driving related tasks (NDRTs) which – as an explicit permission – is unprecedented in Europe and remains in line with liability-requirements for motor traffic in Germany. This again interlocks with the international legal framework in UN-Regulation 157 on Level 3-automation that by design requires a high level of safety. How this has been achieved will be made transparent and an important recent update and extension of the regulation will be reported.

For autonomous vehicles with Level 4-functions the legal framework has a national as well as a European side both legal regulations allow for type approval of small series vehicles – likewise covering full regular use. The national requirements for the approval of autonomous vehicles comprises a detailed set of requirements enacted in the German Road Traffic Act (StVG, 2021) as well as in a corresponding ordinance (AFGBV, 2022). The requirements are detailed and inter alia require a “Technical Supervisor” for these Level 4 vehicles at national basis – which is in line with the remote assistance defined in SAE J3016. At European level the EU 2022/1426 Act opens up a parallel, alternative possibility for the approval of Level 4 vehicles that remains well in line with the safety-relevant requirements at national level but shows a number of differences in detail (e.g. no “Technical Supervisor” is explicitly required therein).
